IMPORTANT: PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE USING THE SERVICES PROVIDED BY DFEND, INC. ("DFEND", "WE", "US", "OUR"). BY ACCESSING OR USING THE SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS.

1. Overview
DFend, Inc. ("DFend") is committed to providing a comprehensive suite of digital identity protection services, including encryption, monitoring, and proactive threat remediation. These Terms of Service ("Terms") govern your access to and use of the services provided by DFend, including its website, mobile applications, and other related products (collectively, the "Services"). If you do not agree with these Terms, you should not use the Services.

2. Eligibility
You must be 18 years or older to use DFend's Services. DFend does not permit individuals under the age of 18 to create an account or use its Services.

3. Subscription Plans
DFend offers the following subscription plans:

  • Freemium Tier: Limited access to basic features.
  • Monthly Subscription: Recurring monthly payment.
  • Annual Subscription: Recurring yearly payment at a discounted rate.
    By signing up for any of these subscription plans, you agree to the payment terms outlined at the time of registration. DFend reserves the right to update or change pricing, billing terms, or subscription plans, with advance notice.

4. Data Privacy and Security
DFend is committed to protecting your privacy and the security of your data. We process your data with AES-256 encryption standards and store it in cloud servers located in your country. By using the Services, you consent to our data practices as outlined in our Privacy Policy, which you agree to review periodically.

  • Children Under 18: DFend does not allow users under 18 to use its Services. We may request users to verify their age via a KYC process within three days of signing up. If age verification is not completed, access to the Services will be restricted.
  • Data Processing: Your data will be processed in compliance with local laws, and you agree to the transfer and processing of your data in accordance with our Privacy Policy.

5. Third-Party Services
DFend may partner with third-party services to enhance the functionality of its platform. By using the Services, you acknowledge that DFend may use these third-party services to facilitate the delivery of the Services, including payment gateways, identity verification, and more. The use of such third-party services is governed by their respective terms and privacy policies.

6. Subscription Billing and Renewal

  • Subscription Charges: You will be billed for your subscription at the frequency you select (monthly or annually). Payment will be processed through the payment method on file.
  • Automatic Renewal: Subscriptions will automatically renew unless you cancel before the end of your current subscription period. You can cancel your subscription at any time by accessing your account settings or contacting DFend support.
  • Cancellation and Refunds: DFend does not provide refunds for unused portions of a subscription. If you cancel, you will continue to have access to the Services until the end of the current billing cycle.

7. Legal Compliance
You agree to comply with all applicable laws and regulations when using DFend's Services, including but not limited to privacy laws, data protection laws, and consumer protection regulations. DFend and its officers are not responsible for any legal violations you may incur through misuse of the Services.

  • Limitation of Liability: To the fullest extent permitted by law, DFend and its officers, employees, and affiliates will not be liable for any damages, including indirect, incidental, or consequential damages, arising from the use or inability to use the Services.
  • Indemnification: You agree to indemnify, defend, and hold harmless DFend, its officers, employees, and affiliates from any and all claims, liabilities, damages, or expenses arising out of your use of the Services or violation of these Terms.

8. Termination
DFend reserves the right to terminate or suspend your access to the Services at its sole discretion, for any reason, including but not limited to violations of these Terms. Upon termination, you will no longer have access to the Services, and any data stored on the platform may be deleted.

9. Dispute Resolution
Any disputes between you and DFend that arise from these Terms or the use of the Services will be resolved through binding individual arbitration, as outlined in our arbitration agreement. You waive the right to a trial by jury or to participate in class actions.

10. Updates to Terms
DFend may modify these Terms at any time. You will be notified of any material changes to these Terms through the email associated with your account. Continued use of the Services after such changes constitutes acceptance of the updated Terms.
